Bryan has diverse litigation experience, which has included insurance coverage and regulatory matters, class action and intellectual property cases, as well as construction defect, landlord/tenant, and various other business disputes.

recent representative experience
  • Philips Electronics North America Corporation, et al. v. BC Technical, Inc., No. 2:08-CV-00639-CW-SA, United States District Court for the District of Utah. Bryan and his colleague, Roger Kindley, led a team who represented a manufacturer/supplier of nuclear medicine equipment in this intellectual property case involving claims of copyright and trademark infringement, trade secret misappropriation, predatory hiring and unfair competition. Experts had calculated damages to exceed seventy million dollars. Through extensive discovery efforts, motion practice, and witness examination at evidentiary hearing, Bryan and Roger helped to expose and persuasively present egregious acts of spoliation of electronic evidence and contempt of court. Dedicated work and advocacy obtained “terminating sanction” orders from the federal district court, which struck the defendant’s answer, dismissed its counterclaims, imposed monetary sanctions, and entered default judgment as to liability in favor of the clients.  Copies of the pertinent Court decisions are available at: 2011 WL 677462 (D.   • Philips Medical Systems (Cleveland), Inc. v. Hale, et al., No. 2:10-CV-00816-CW-PMW, United States District Court, District of Utah. Bryan and his colleague Roger Kindley prosecuted this trade secret case, which also involved liabilities of corporate officers and directors. After motions and limited discovery, a multiparty mediation led to successful settlement and immediate payment for the client.
  • Nosworthy Telecommunication Distributor, Inc., et al. v. Samsung Telecommunications America, LLC, No. 10-2-04544-7, Superior Court of Snohomish County, Washington. Bryan represents a leading telecommunications company in this lawsuit, defending against multiple causes of action relating to a terminated distributor agreement. Bryan persuaded the trial court to enter summary judgment in favor of the client on all claims, as well as to impose sanctions against the plaintiffs.
  • Canyon Crossing, LLC, et al. v. HomeStreet Bank, No. 10-2-21361-9, Superior Court of King County, Washington. Bryan and his colleague, Jerry Kindinger, represented a commercial real estate development company and guarantors in this dispute involving a multi-million dollar construction loan. Bryan and Jerry helped to successfully resolve the case prior to trial.
  • Poulsbo Group, LLC v. Talon Development, LLC, No. 38984-3-II, Washington State Court of Appeals, Division II. Bryan represented a real estate development company in this case involving claims of breach of contract, breach of good faith and fair dealing, and intentional misrepresentation. Bryan convinced the Court of Appeals to reverse a trial court order dismissing the claims of breach of contract and the implied covenant of good faith and fair dealing. Decision available at: 155 Wn. App. 339, 229 P.3d 906 (2010).
    Melrose v. Stewart Title Guaranty Company, No. 08-2-00914-3, Superior Court of Island County, Washington. Bryan successfully defended a major title insurance underwriter in this lawsuit involving right of access issues. Bryan convinced the Court to dismiss the plaintiff’s claims on summary judgment prior to trial.
  • Blaylock, et al. v. First American Title Insurance Company, et al., No. C06-1667, United States District Court for the Western District of Washington. Bryan and his colleague, Jerry Kindinger, defended title insurance companies in this putative class action lawsuit alleging violations of consumer protection laws and the Real Estate Settlement Procedures Act. Bryan and Jerry worked to achieve a dismissal of the plaintiffs’ claims by the federal district court and a successful resolution for the clients.
  • Image Technology Consulting, Inc. v. Cardio Diagnostic Imaging, et al., California Superior Court, Los Angeles County, No. SC094757. Bryan defended a major medical equipment manufacturer and service provider in this litigation involving allegations of fraud and tortious interference. Bryan worked to obtain a dismissal of the claims against his clients prior to trial.
